From 2 October 2026, Australia introduced new rules governing who can apply for a Student Visa while physically present in Australia (Onshore).

The new legislation includes a list of temporary visa subclasses whose holders must be outside Australia to apply for a Student Visa. Importantly, this list now includes:

  • Subclass 417 – Working Holiday Visa
  • Subclass 462 – Work and Holiday Visa

The list also includes several other temporary visas, including certain temporary work, training, graduate and visitor visas.

This means that if you currently hold a Subclass 417 or 462 visa and want to apply for a Student Visa, you can no longer simply lodge your Student Visa application while remaining in Australia.

The change does not mean that Working Holiday Visa holders are prohibited from studying in Australia or applying for a Student Visa altogether.

Instead, the major difference is where the Student Visa application must be lodged.

If you are affected by the new rules, you will generally need to:

  1. Prepare your course enrolment and Student Visa application.
  2. Leave Australia before lodging the Student Visa application.
  3. Lodge the Student Visa application while you are outside Australia.
  4. Be outside Australia when the Student Visa is granted.

The Department of Home Affairs specifically states that people who are required to apply offshore must be outside Australia both when they apply and when the Student Visa is granted.

Potentially, if you hold another valid visa that allows you to enter Australia.

However, there is an important catch.

Home Affairs states that an applicant who has lodged their Student Visa from outside Australia may return to Australia on another valid visa while the Student Visa is being processed, but they must be outside Australia again when the Student Visa is granted.

This can make travel and visa planning significantly more complicated.

Applicants should therefore carefully consider their individual circumstances before booking flights or making financial commitments.

A Student Visa application lodged outside Australia does not provide you with a Bridging Visa connected to that offshore application.

This is an important difference compared with many onshore visa applications.

Home Affairs confirms that applicants who are required to lodge their Student Visa offshore will not receive a Bridging Visa linked to that application.

For Working Holiday Makers approaching the expiry of their current visa, timing therefore becomes particularly important.

If the new rules require you to be outside Australia and you attempt to lodge the application while you are in Australia, the application will be invalid.

Home Affairs warns that an invalid application may also have consequences for your visa status, particularly if your existing visa has already expired.

For this reason, it is important to check whether you are eligible to lodge onshore before submitting an application or making major study and travel arrangements.

There is an important distinction for applications that were already lodged before the new rules commenced.

According to Home Affairs, Student Visa applications lodged before 2 October 2026 will continue to be assessed under the rules that applied when they were lodged.

Therefore, the introduction of the new rules does not automatically make an existing valid Student Visa application invalid simply because it was lodged while the applicant was in Australia before 2 October.

If you are currently in Australia on a Working Holiday (417) or Work and Holiday (462) Visa and are planning to transition to a Student Visa, do not assume that your previous visa strategy will still work.

Before making a decision, consider:

  • When does your current Working Holiday Visa expire?
  • What course do you want to study?
  • When is your intended course start date?
  • How long will you need to be outside Australia?
  • How will an offshore application affect your accommodation, employment and travel arrangements?
  • Are there any other visa options relevant to your individual circumstances?

Because an offshore Student Visa application does not provide a Bridging Visa, planning the transition well before your Working Holiday Visa expires has become even more important.
